In this week's Ask-an-Expert episode, I'm joined by Rose Leto with Neinstein LLP. Rose, thank you for joining us from Toronto via Skype tonight.

Thank you for having me.

So tonight we're talking medical negligence. Rose, is there a difference between medical malpractice and medical negligence?

They're really synonymous when you have whether it's medical negligence or medical malpractice came. You're looking at establishing that there was a breach in the standard of care — some elements of negligence on behalf of the healthcare team.

All right, so what are the different types of medical negligence or medical malpractice? Some examples.

So there's a whole host, a whole gamut of things. It could be anything from delayed diagnosis to misdiagnosis. To that the most severe injuries of birthing injuries or miss stroke diagnosis infections, the whole wide gamut of anything that can go wrong during your medical treatment.

Now, what are some of the consequences of medical error?

It can be devastating. Obviously, there could be the most severe outcome, including death. But one of the most devastating ones that we see involves obstetrical negligence and birthing cases. Where you have a mom and a new baby who has a severe or a bad outcome. And the task on the mom to take care of that child for the rest of that child's life - can be quite overwhelming and devastating to the entire family.

Absolutely. Well, Rose, what can a person expect if they do choose to pursue a case?

They can expect to consult a lawyer or someone who specialized in the area, and we always conduct an investigation upfront, and so that involves attaining all the medical records, checking in with an expert. The litigation can be quite time consuming and quite lengthy. You could take a number of years to get a result.
